THESE GENERAL TERMS AND CONDITIONS ARE INCORPORATED INTO ALL BOOKINGS WHETHER MADE ONLINE, BY TELEPHONE OR BY ANY OTHER METHOD, AND INTO ALL CONTRACTS FOR THE SUPPLY OF GOODS OR SERVICES BY MARIKA PAGE
Let us introduce ourselves
Marika Page is a trading name of Marika Page Fashion Stylist Limited, a company incorporated under the laws of England and Wales with company number 11355481 and with registered address at 21 John Bends Way, Wisbech, Cambridgeshire PE13 4PS (“we/us/our”).
We can be contacted by email at info@marikapage.com or by telephone on 07535 877851.
Your contract is with Marika Page Fashion Stylist Limited (trading as Marika Page).
Our services are described on our website at www.marikapage.com (“our website”).
All Marika Page creative direction and styling services are provided by us and performed by Creative Director and Stylist Marika Page (“Marika”)
Your contract with us
The terms of your contract with us are contained in the description(s) on our website of the specific service(s) purchased and in these general terms and conditions. We believe in your individuality, so if you require additional services not mentioned in the relevant description on our website, your contract with us may be varied by further agreement in writing between you and us to include those additional services where available. Additional fees may apply.
We are continually looking for ways to enhance and improve your Marika Page experience so please check our website regularly for new services, packages and special offers.
Optimising our services for you
To ensure that you get the most from our creative direction and styling expertise, we operate the following policies in relation to our respective services:
Personal Styling Shopping Trip:
Individual pieces are carefully selected in accordance with your Wardrobe Planning & Assessment (if performed) to avoid items you may not need and to make the most of the clothing you already have, your Body Analysis (if performed) and your Personal Colour Analysis (if performed), and in accordance with your specific needs.
Although we are sure that you will love our selection, we will work with you to find the perfect combinations. Unfortunately we cannot perform re-selection of items based on views of third parties of our selection, whether those views are expressed by telephone, text or in person, during or after the Personal Styling Shopping Trip.
To enable us to focus exclusively on you and to ensure that you have all the physical space and headspace you need in the styling room, we are unable to accommodate accompanying persons on the Personal Styling Shopping Trip.
The prep day included in a one-day personal styling shopping trip usually means selection at Harvey Nichols only. We will look at other stores on an exceptional basis on request, if agreed in writing between you and us.
VIP Styling Package and the Superior Styling Package:
The prep day included in the VIP Styling Package and the Superior Styling Package means selection at Harvey Nichols and online at Net-A-Porter and/or Mr Porter and/or such other stores as we may identify from time to time to find you the best possible selection.
Personal Colour Analysis:
If you require the Personal Colour Analysis to be performed remotely, we will need to send you our colour drapes for your perusal. To keep the world turning, we require you to deliver the colour drapes back to us within 7 days of the date of your Personal Colour Analysis remote appointment. A reasonable charge for courier collection will apply.
Body Analysis:
The purpose of the Body Analysis report is to show examples of clothing options in flattering cuts and colours. No warranty is made that the items shown in the Body Analysis report will be available during the Personal Styling Shopping Trip.
Wardrobe Planning & Assessment:
As a graduate of the British College of Professional Styling, Marika is a firm believer that trying on the clothing you already have is the only way accurately to assess fit and colours, and ultimately to decide what to keep and what to recycle.
The Wardrobe Planning & Assessment is a deeply rewarding experience but it is not for the faint-hearted! Expect to take multiple photos of yourself trying on old items or clothing you no longer feel suits you. Expect photos showing the full range of you: the flattering and the not-so-flattering. It will take time and patience but the result will be worth it. Because you are worth it.
We (you and us) will agree on a list of items that improve on the styles and colours you already have. If you also purchase the Personal Styling Shopping Trip, the list will form the basis of the selection of items on the prep day.
Whereas we will make recommendations as to which items to keep and which to recycle, we take no responsibility for any decision to recycle an item. That decision is entirely yours.
Reports:
For reasons of privacy and confidentiality we are unable to provide samples of our reports. You are invited to browse our website for examples of our work and collaborations.
Photo shoot:
Your photo shoot will be based on the Creative Direction you agreed in your mood board, mind map, and personal branding messages. Please ensure that you are happy with the Creative Direction, and that you request any amendments, before authorising the design strategy and booking your photo shoot. As your creative team will prepare in accordance with your brief, at significant time and cost. Although we strive to maintain flexibility, and offer alternatives on the day if something is not working, once work has commenced by your creative team, it may not be possible to make any significant changes. As significant last-minute changes made by you to the Creative Direction agreed would inevitably compromise standards given the limited time to prepare.
Your needs are our needs
Like many creative enterprises, by entering into partnerships with suppliers, we are able to pass on benefits to you such as hospitality, free delivery, exclusive space, offers, reductions, etc. In return, we may from time to time earn incentives for or profits from or commission on sales of certain merchandise. For reasons of confidentiality, we are unable to divulge the precise terms of our partnerships.
Regardless of whether our selection is made at Harvey Nichols or at another store or stores, our relentless mission is to deliver clothing and an itinerary which are perfect for you. We are driven by your needs, not ours.
Supplemental clothing
Our supplemental clothing is sold at recommended retail price (RRP). However, some items may be discounted, which will be indicated during the styling session. Our pricing of supplemental clothing reflects a wide range of factors, such as rareness, availability/difficulty to source, store location, nature of stock (warehouse or retail), and delivery costs, without exceeding RRP. Prices are as stated on item tags and are not negotiable. The purpose of the supplemental selection is to fill in the gaps of what may not be available at store, to give you the best results, greatest choice and the most flattering cuts and colours possible across seasons. There is no obligation to make any purchase from the supplemental selection.
Return of supplemental clothing
We ask that you carefully check that you are happy with your purchases as we are unable to process returns unless they were delivered to you damaged or faulty.
Warranties, limitations and indemnities
Beauty is in the eye of the beholder. The question of whether you love or hate any particular item in our selection is entirely subjective. We do our best to select cuts and colours which fit you and your wardrobe perfectly but we make no warranty that you will accept our recommendations. We do warrant that we will use reasonable care and skill in performing the services to a standard conforming to generally accepted industry standards and practices.
If (which we hope will never happen) any part of our services is performed negligently or in breach of any term of your contract with us then, at your request (if the request is given within one month of completion of the performance of the relevant part of service), we will re-perform the relevant part of the services, subject to the exclusions below.
In any event, we are always open to truthful feedback.
Except in the case of death or personal injury caused by our negligence, our liability under or in connection with your contract with us whether arising in contract, tort, negligence, breach of statutory duty or otherwise howsoever, shall not exceed the fee paid to us under your contract with us. This does not apply in relation to the indemnity mentioned below.
Neither of you or us shall be liable to the other in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by that other of an indirect or consequential nature including without limitation any economic loss or other loss of turnover, profits, business or goodwill. This does not apply in relation to the indemnity mentioned below.
Indemnity: you shall indemnify and hold us harmless from and against all claims and losses arising from loss, damage, liability, injury to our employees and third parties, infringement of third-party intellectual property, or third-party losses by reason of or arising out of any information supplied to you by us, our employees or consultants, or supplied to us by you within or without the scope of your contract with us. “Claims” means all demands, claims, proceedings, penalties, fines and liability (whether criminal or civil, in contract, tort or otherwise); and “losses” means all losses including without limitation financial losses, damages, legal costs and other expenses of any nature whatsoever.
We and you acknowledge that, in entering into your contract with us, we do not do so in reliance on any representation, warranty or other provision except as expressly provided in your contract with us, and any conditions, warranties or other terms implied by statute or common law are excluded from your contract with us to the fullest extent permitted by law. Nothing in your contract with us excludes liability for fraud.
Timings
We are sure that you will enjoy the service you purchase. And time flies when you are having fun! That’s why we have to stipulate that each session will run no longer than the time allocated for the appointment. You agree to co-operate reasonably with us to ensure a satisfying and timely finish to each session. Any lost time caused by a delay in starting a session will be made up at the end of that session unless otherwise agreed between you and us.
Fees
Your contract with us supersedes all previous agreements for our services, including any agreements as to fees. The current fees for our services are as stated on our website next to the respective service descriptions and are not negotiable.
Let’s communicate
At Marika Page we provide a bespoke service with an aura of prestige and luxury in elegant surroundings. We promise to interact with you in a courteous, respectful and professional manner. Under your contract with us, you agree to interact with us and your Creative Director and Stylist Marika in a courteous and respectful manner. That way, your Marika Page experience will be enhanced by a mutually-rewarding shared positive attitude. This will be particularly useful for the Personal Styling Shopping Trip and the Wardrobe Planning & Assessment, which may require patience, stamina and plenty of smiles! We may terminate any session immediately without refund in the event of a serious breach by you of this term.
Our hours of business are 10am to 6pm from Monday to Friday. Our preferred method of communication is by email. If we have provided you with Marika’s personal mobile number, you may use this during our hours of business only and for business purposes only. Communications by WhatsApp are not accepted at any time unless from a number outside the UK. In general, we do not offer pre-contractual video calls by Zoom or other video call app.
As Marika performs all Marika Page creative direction and styling services personally, there will be times when she is not immediately, or consistently, available by email, telephone or text. For example, if she is in an appointment with a client, a store or engaged in a creative process for a client, she may be totally unavailable to all other clients during that time. In this situation, she would normally get back to you by phone or email within a reasonable timeframe. In most instances that will be within 24 hours, but it may sometimes be longer, for example, where she is bringing to a client the same artistic commitment as she will bring to you. Please bear with us, but if your need is genuinely urgent, please text specifying that you are inquiring about a potential booking (so that your message can be effectively screened against unsolicited sales communications).
Postponements
We realise that plans can change. Any booked appointment may be postponed once, subject to availability of an alternative date or dates. A fee of £200 will apply to each subsequent postponement, subject to availability of an alternative date or dates, save where the postponement is due to your or our illness from COVID-19.
Cancellations
A purchased service may be cancelled at any time with a full refund if work has not yet commenced on the booking. No refund is available for cancellation of a purchased service where work has commenced on the booking, or if any of our intellectual property regarding our creative process has already been provided to you. If a Styling Package is cancelled, only those services in respect of which work has not commenced may be refunded.
Intellectual property and confidentiality
All intellectual property rights in or arising out of or in connection with our services (other than intellectual property rights in any materials provided by you) are and shall be owned by us. You may not copy the reports we provide you or any part of them. Our Creative Direction process is confidential and except as may be required by law or by any competent authority you shall not without our express written permission divulge the same or any part of it to any person. You may not use or exploit the reports we provide you or any part of them or our Creative Direction process or any part of it for any commercial purpose. These are for personal use only!
Final words
Neither you nor us shall have any liability under or be deemed to be in breach of your contract with us for any delays or failures in performance of your contract with us which result from circumstances beyond your or our reasonable control.
For the purposes of the Contracts (Rights of Third Parties) Act 1999, your contract with us is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.
Your contract with us shall be governed and construed in accordance with English law and the English courts shall have non-exclusive jurisdiction in relation to any dispute arising out of or in connection with it.
